DRAFT: replace everything in [BRACKETS], then have it checked before you publish. This is a starting point, not legal advice.

1. About these terms

These terms are between [YOUR BUSINESS NAME] (ABN [ABN]) (“we”, “us”) and the business that buys a website from us (“you”). They apply when you tick the box on your website preview and pay. The version shown when you pay is the one that applies to your purchase.

2. Your preview

  • We may build a preview of a website for your business before you have agreed to buy anything. You are under no obligation to buy it.
  • Your preview is private and protected by a password we give you. Please don’t share the password outside your business.
  • Until you pay in full, the preview and everything in it (design, code, text and images we supplied) belong to us. You may not copy, publish or reuse any part of it, or have someone else rebuild it, without paying for it.
  • We may take a preview down at any time before it is paid for.

3. Changes before you pay

  • Your preview includes the number of change rounds shown on it (usually two). A round is one set of changes sent using the “Suggest changes” button, so it is best to list everything you want changed at once.
  • We will make reasonable changes within the scope of the website shown. Large changes, such as new features, extra pages or a completely different design, may need a new quote.
  • Once your included rounds are used, you can still buy the website as it is, or ask us about further changes.

4. Price and payment

  • The price is shown on your preview in Australian dollars and [includes GST / does not include GST].
  • Payment is made in full, online, through Stripe. We never see or store your card details.
  • By paying, you confirm you have approved the website as it is shown in the preview at that time.

5. Going live

  • After you pay, we will publish the website on your domain name, usually within [5] business days of receiving any domain access we need from you.
  • Your domain name stays registered in your name. If you don’t have one, we can help you register one in your name; domain fees are [included / charged separately].
  • Delays caused by waiting for information or access from you, or by your domain registrar, are outside our control.

6. Hosting and support

  • [Hosting of your website is included for the first [12 months]. After that it is [$X per month / year], and we will tell you before any charge applies.] (Change this to match what you offer.)
  • After launch, you can ask for help or changes through your private support page. [Small text and photo updates are included for [30 days] after launch.] Other changes are quoted before we do them.
  • We aim for your website to be available at all times but can’t guarantee it will never be interrupted, for example during maintenance or problems with internet or hosting providers.

7. Your content

  • You confirm that you own, or have permission to use, anything you give us for your website, such as logos, photos and text.
  • You are responsible for making sure the information on your website (prices, opening hours, licences, claims about your services) is accurate and lawful. Please check it before you approve it.

8. Who owns the website

  • Once you have paid in full, you own the content you supplied, and we give you ownership of the design and text we created specifically for your website.
  • Some parts belong to others and are licensed, not owned, for example fonts, stock photos, icons and third-party services such as maps or booking tools. You may use them on your website under their licences.
  • We keep ownership of our general tools, templates and code that we reuse across websites, and give you a permanent licence to use them as part of your website.
  • We may show your website in our portfolio unless you ask us not to.

9. Refunds and your consumer rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. If something we deliver doesn’t match what you approved, tell us through your support page and we will fix it. Because you see and approve the finished website before paying, we don’t offer refunds for a change of mind once you have paid.

10. Limits on our liability

To the extent the law allows, if we fail to provide our services properly, our liability is limited to providing the services again or refunding what you paid for them, and we are not liable for indirect losses such as lost profits or lost business. We are not responsible for services run by others, such as Stripe, your domain registrar or third-party tools on your website.

11. Privacy

We handle personal information as set out in our Privacy Policy.

12. General

  • These terms are governed by the laws of [New South Wales], Australia.
  • We may update these terms for future purchases. Changes don’t affect a purchase you have already made.
